Part 1 Program Description

Non-competes have been a topic of national conversation, particularly after the FTC proposed banning those agreements for most employees.  While the federal courts have put that FTC ban on hold, employers hoping to protect legitimate business interests must plan carefully in order to implement effective non-competition, non-solicitation, and non-disclosure agreements.

Learning Objectives

In this session, you will learn:

  • Understand the key components of non-competition, non-solicitation, and non-disclosure agreements and how to structure them for maximum protection.
  • Learn strategies and tips for employers to enhance the effectiveness of their non-compete agreements.
  • Analyze the economic implications of enforcing non-compete agreements and their impact on businesses and employees.

Part 2 Program Description

This program will cover worker classification under the Fair Labor Standards Act and the potential damages and penalties that can result from misclassification or failure to pay overtime or minimum wage to employees. The program will also address potential strategies for mitigating damages and penalties resulting from violations of the FLSA.

Learning Objectives

  • Gain a general understanding of worker classification under the FLSA, both with respect to exempt and non-exempt employees as well as independent contractors.
  • Gain an understanding of the kinds of damages and penalties that can result from worker misclassification under the FLSA.
  • Gain an understanding of potential strategies for employers to mitigate damages and penalties under the FLSA.

How to earn your credit:

  • Participants of the live broadcast are eligible to receive 2 CPE credit in Business Law. You will need to attend for 100+ minutes and answer 6+ polling questions for CPE credits.
  • Partial credit will not be offered.
